Feeling Punked over Guns

Everyone knows by now I just am in love with everything democrat. The two party system is the best system ever. In fact, if god himself/herself could have invented the perfect political system it would be one in which two dominant parties could become so confident of their divine calling that they would nobly and bravely ignore all of the voters in the nation and instead tell them whom they should vote for, rather than having to suffer the strain and indignity of having to decide for themselves.

We sure did hear a lot about guns this year. Every time Obama said something like, “whoa, guns” the rightwing media erupted with screams decrying gun grabs by the government. Recall Des Moines and Salt Lake City, in which Obama goons in black armor helicoptered in and confiscated all of the guns. But the media hysteria was the alarm to a public to rush out and buy guns before they were banned. The result, despite an, eh, year for the stock market saw gun profits were through the roof.

I naively asked why Obama was essentially silent and action-less on gun issues of any kind, save for the occasional laconic “somebody ought to do something, sometime,” which translated into “FOX-ese,’meant, of course, GUN BAN! But what if it was all just a game? Hmm. What if both parties really were the same, except to make it competitive and compete for individual fortunes and privilege through the dichotomy of their respective bases. Sort of like, people from both parties went off to lobbying firms, Monsanto, weapons industries, banks and oil companies? Wouldn’t that be a co-inky-dink?

So maybe Obama, who spent far more energy getting TPP passed than he did on single payer, who could have paid the mortgages of damn near every foreclosed homeowner instead of the trillions given to banks, is in the pocket of the gun industry. Okay, maybe just in the pocket of the corporate America, you know like giving insurance companies a windfall which is enforceable under penalty of law, or a backdoor boost to companies who no longer need to offer insurance or fulltime work as part of a compensation package.

And maybe going after whistleblowers as if they were public enemy number one is all just a coincidence, sort of like fining an oil company within their profit margin after a historic oil spill destroyed tens of thousands of lives, killed as many as three dozen (including suicides, but not cancers) and ruined the Gulf of Mexico. That’s all probably coincidence.

So the gun industry finishes the year with record profits. How to start the new year, at a time when the economy is struggling and the stock market is getting pounded by the China market? Let’s put our heads together and find something that isn’t affected by China. I know, GUNS!

So Obama has been silent, or at the very least ineffectual about anything on guns. So why now? Within hours before Obama even said a word on gun violence the gun industry, gun legislation or gun banning. Where were the presidential orders to stop straw purchases or gun show loopholes? So why now? The Gun industry and NRA will happily tell you. It’s because its a new year. Profits are up just on the word of the industry’s best salesman, according to ex-congressman Joe Walsh. And that may be the only time I ever agree with that child support abandoning, self-felating, gun pornographer-pushing, tea bagging, anti-Christian, lying, pretend tough guy, hypocrite and cat raping, Joe Walsh.

I just threw in the cat raping part for purely satirical and political commentary purposes, pursuant to my first amendment rights and antipathy for cats. Still, I can’t help feeling I have been punked, and while my disdain for the right and gun-porn industry remains peaked, I have a feeling Obama’s hands are hardly clean on this one too.

Milwaukee Sheriff calls #BlackLivesMatter Terrorists

Milwaukee County Sheriff David Clarke said on Twitter Tuesday that Before long, “Black Lies Matter will join forces with ISIS to b(r)ing down our legal constituted republic. You heard it first here.” It was an open comparison with a foreign terrorist group. Speaking this morning on a rightwing radio show in Chicago Clarke, now the darling o the rightwing media also linked ISIS with Iran, although the two are enemies. Iran currently is a was with ISIs.

He spoke on AM560 in Chicago, known for it attacks Clarke’s conspiracy paranoia would just be the confused ramblings of a fool if his NRA backed elected official did not have the power of life and death over people. This from Salon earlier this year:

“Of course, deflection is an effective tactic. A real organization doing a good deal of terrorizing is Clarke’s own Milwaukee police department, which according to Salon has been sued for dozens of illegal strip searches and has seen multiple officer-involved killings of unarmed black citizens during Clarke’s tenure, including Dontre Hamilton in 2014 and Derek Williams in 2011. What do black citizens of Milwaukee have to fear from terrorists overseas when the threat of death hangs over them from their own police everyday?”

Cark’s framing of #BLM as a terror organization, claiming also that ISIS is infiltrating SEIU and other labor organizations brings up disturbing questions about the safety and civil rights of civilians in Milwaukee County. Will or are his officers harassing or targeting anyone displaying #BlackLivesMatter signs? Even more, Clarke believes and said this morning that America can and should arrest its way out of the current social and economic turmoil plaguing the inner cities and poor.

Yet Clarke is silent on economic development, the banks and Wall Street in creating the foreclosure crisis which has crippled Black, minority and poor communities, and has called for open armed rebellion against any reasonable gun legislation. Most guns used in crimes in Milwaukee, like neighboring Chicago come from guns bought legally which are then given r sold to criminals; so-called straw purchases. Badger Guns in Milwaukee was found liable this month in a straw purchased linked to the shooting of two police officers. Ironically, Clarke’s own department could see a financial windfall from lawsuit against Badger and other gun outlets accused of straw purchases.

Meanwhile, the voters must realize that the true threat of terror faced n Milwaukee County comes from ulra-authoritarians, media hounds and protectors of the culture of greed, racism and corruption that have driven inner cities and the poor into corners of desperation in a society which then blames the symptoms but ignores the disease.

Proposed 28th Amendment to the Constitution of the United States of America: The Ninja Amendment

Be it soon resolved that We the People of these United States of America hereby propose that all schools in this great nation will henceforth be guarded by “good” Ninjas through a Constitutional convention of the States and ratified by the Congress. We further contend that this is as valid and an equally responsible response to initiatives to militarize schools with guns, forcibly arm teachers and increase the proliferation of guns by creating a virtual army to patrol the 130,000 schools in the nation. A single well-hidden Ninja would be far more effective and a greater deterrent than a dozen roaming part-time security guards.

Be it also noted by all parties that not a single crime or mass violence has ever been attributed to Ninjas, and that Ninjas are silent and stealthy and could dispatch a criminal with such lethal force as to provide minimal or no disruption to students, unlike a gun battle in a hallway. Further, it is laid down here that if it is proposed to force teachers to carry guns, that the wiser course, grasshopper, would be to train teachers in the moral, honorable and philosophical ways of the Ninja. Be it expressed in the strongest terms that the benefits to children schooled by Ninja teachers would reap untold positive benefits for America’s children. God himself forbidding a crisis, a school-full of children trained in the ways of the Ninja would become a formidable army in their own right.

We here affirm the noblest aspects of the Ninja. A Ninja never panics. a Ninja is kind and perpetually helps those in need. They are courageous, adaptable, versatile, patient, and persistent. Ninjas express loyalty to ones country, loyalty to ones parents, trust and brotherhood among friends. Ninjas believe that large egos are carried by small minds. Ninjas never cry.

Upon this date the draftees of this bill declare that this is the Ninja Amendment as proposed. We call upon the people of this nation to spread this proposal far and wide to all citizens, their elected representatives and the National Rifle Association for the sake and safety, the sanity and security of these United States.

Gun Free State

Guns do not lesson the police state, they enshrine the police state. Gun proliferation does not protect freedom, it eliminates it. Everyone presumed a possible suspect in the aftermath. 4th , 1st, 5th and even 2nd amendment rights suspended whenever the police and state decide there is a security risk. Mass searches without warrant. Mass detention. Those suffering and managing mental illness are now trolled by neighbors, law enforcement and the state. For god’s sake don’t reveal that you have ever been depressed, manic, bipolar to any degree. What else becomes scrutiny to the state and to the suspicious minds? ADD. There are calls now to make medical records available to the state as part of ongoing profile and management of who should not only own a gun, but who should be watched and monitored.

You are surrendering your rights through the enrichment of the gun industry.

DARK HORSE: Bernie Sanders 2016- Murder and the Media

It was murder pure and simple.

At about 10:45 a gunman, identified as 24 year old Mohammod Youssuf Abdul-Aziz, began a shooting spree in Chattanooga Tennessee, targeting military personnel. Four Marines were killed. A Marine and sailor, and at least one policeman were wounded. Authorities were quick to describe the attacks as domestic terrorism. It took days before that same term was applied to the Charleston Church Massacre in which 9 were killed by Dylann Roof, a self-described white supremacist. Lost to the histrionics of the rightwing and cable news media were critical questions regarding both attacks.

On a local Salem radio affiliate several callers called this an act of war. Former republican tea party representative Joe Walsh was adamant that America is at war with Islam. He was quick to dismiss Dylann Roof as a loner, evil and insane. For Walsh, yesterday on his program, Abdul-Aziz, an American citizen born in Kuwait, was confirmation of the antipathy all Muslims hold for America. Walsh quoted a wholly unsubstantiated number of hundreds of millions of Muslims aligned with ISIS or openly calling for the destruction of the West. That number is derived from a false estimate proliferated in the media of “10% of Muslims around the planet hating America. Bigots like Walsh, sowing and promoting hatred and discord for political purposes, simply have accepted and added to that fictitious figure.

While the media was very quick to connect Abdul-Aziz with ISIS, capitalizing that ISIS claimed responsibility for the attack, there was almost no investigation into Roof’s connections to white supremacist groups. ISIS, to be accurate, has called on Muslims in America to attack military targets. White supremacists have called for a new American revolution, quoting Jefferson’s “blood of tyrants and patriots.“ Michael savage, along with virtually every rightwing pundit has called Barack Obama a “tyrant.”

There are critical questions not being addressed in the national narrative. They are, instead, being narrated and spun for political party expediency. On July 4th, The New York Times reported that Roof had indeed been in contact with local white supremacists groups. While there is no evidence they directly encouraged the shooting at Emanuel African Methodist Episcopal Church, they certainly inspired a malleable young mind. The State newspaper in Columbia, S.C., reported that officials had widened their investigation to others who may have helped Roof in some way. The same seems true for Abdul-Aziz, who lived in a comfortable upper middle class home and was described by friends and family as a likable, easy going person. At some point, like Roof, he became radicalized and driven to an act of terrorism.

Attention for the shooting shifted in the media, pushed by the NRA, doubtlessly to protect market interests and profits, to the gun free zone sign on the door. The easy answer as to why soldiers, as many, including Walsh, were demanding, do not carry guns just as off duty police officers may within limits, is that America is not a military junta. The Posse Comitatus Act was signed into law on June 18, 1878 by President Rutherford B. Hayes. The purpose of the act, supporting the Insurrection Act of 1807 was to limit the powers of the federal government in using soldiers to act as domestic law enforcement personnel. The Act of 1807, incidentally, was signed into law by then President Thomas Jefferson.

Reports and shell casings outside the door where the Marines were killed indicate an ambush. Being armed would have made no difference in this case. The Marines were killed at their desks as Abdul-Aziz, who was later killed by police, fired multiple rounds through the windows. While notable and shocking, the attack also comes at a time on falling crime rates nationally. The assertion by pro-gun activists and the NRA to openly carry guns into public buildings, private businesses, restaurants and shopping centers has led to growing complaints by many who feel intimidated by the weapons as they wait in line for coffee or shop. The intimidation aspect is a clear feature of the activism, a factor that carries the threat of violence.

A clear majority of people, oppose open carry, while supporting reasonable second amendment rights. A University of Texas/Texas Tribune poll found that 68% of Texans were opposed open carry(http://www.newsmax.com/US/open-carry-guns-texas-poll/2015/02/24/id/626526/). Those numbers are consistent nationally.

There is also a greater concern, and that is that we have fallen prey to politicized and corporatized media on both sides of the political spectrum that is unwilling or incapable of adequately informing the American people. News was never intended to be a commodity that is bought and sold, and which is subject to the whims of the powerful and wealthy to control the populace. News was intended to inform the public on issues critical to responsibly maintaining a healthy, functioning democracy. The Public airwaves changed from the late 1980’s as corporate consolidation gobbled up local and national programming. 94% of all media in the country is controlled by just 3 corporations. Those corporations also pour billions into swaying government opinion. The media outlets they own and control as less news organizations and more company messaging wings.

There is a critical lack of confidence in once trusted institutions. The rightwing decries the liberal media, while the left decries the corporate and rightwing media. Those who commiserate with the suffering of innocent Palestinians and Israelis become outraged as the media and politicians unfairly favor one side over another. Network news refuses still to adequately discuss climate change, and allows deniers unchallenged on programs. That media impugns and denounces, or ignores altogether the fight for fair wages and the Occupy movement, but is sympathetic to a far smaller Tea Party movement of belligerents. There is no confidence any longer in leadership. That is dangerous.

Young people and the disillusioned have fled from that media towards the so-called alternative media of the Internet. The internet, through Facebook and other venues can radicalize the susceptible and gullible. It is quite possible and easy to settle into a cul-de-sac online of information and views that insulate some from any other information, but that which validates and strengthens skewed perspectives on the world and their community. Facebook in 2014 was excoriated for an experiment in which they focused certain types of stories as a means of manipulating users. In the cases of Charleston and Chattanooga, it would seem that was a lesson ISIS in reaching Abdul-Aziz and white supremacists and anti-government types taught to Dylann Roof.

Accidental Shooting’s Skyrocket

A survey of gun incidents by Revolution and Beer has found an alarming trend. Following a wave of conceal carry and gun proliferation legislation across the country, accidental shootings and road rage incidents have skyrocketed, eclipsing any potential benefit from civilian gun proliferation across the country. the survey was tallied from local and national news reports from all 50 states of road rage/accidental shootings as well as stories showing guns in a favorable light. The survey also took into account data and reports from so-called pro-gun advocate sites and publications. That survey found that for every story showing guns favorably there were 14 which underscored the negative effects of gun proliferation in civil society.

Violent crime and gun crime has continued to decline year over year for more than a decade. Conceal carry laws and proliferation efforts and propaganda by the gun industry and the NRA, ostensibly to boost sales, has had little to no effect on crime. The trend was well under way before laws came into effect. Florida, which introduced conceal carry laws in 1987 actually saw an increase in violent crime, robbery and murder. those numbers declined slightly between 1990 and 2013 but still remain far above the national average, despite that gun advocates continually hold up Florida’s pro-gun legislation as a template for the rest of the nation. Homicide and crime rates in Texas have remained constant since 1990 despite well publicized and aggressive proliferation there.

By contrast, Illinois, which had some of the toughest gun restrictions in the nation saw sharp drops in nearly every crime category. Robbery declined by nearly 40%, while aggravated battery declined in Chicago by almost half. Between 1990 and 1994 murders in Illinois peaked at an average of 1300 annually, driven primarily by gang crime in Chicago. In 2013, Illinois’ murder rate overall had declined to 706 for a population of just under 13 million people. Despite sensationalistic coverage of Chicago’s murder rate, driven by pro-gun interests crime rates in Chicago continued to decline overall. Social and neighborhood programs, innovative policing with state and local gun laws helped drive down violent crime rates in the city. Since 2000, from a peak in murders of 665 in 2001, 2014 closed with 425, still a tragically high number.

Recently in Wasilla AK, a 4 year old boy was shot in the leg when his mother dropped a weapon and it discharged. A Las Vegas woman was killed during a shoot out between an acquaintance and her son in their front yard in an incident attributed to road rage. A Michigan gun advocate, Christina Bond was killed in a fatal gunshot to the eye while adjusting her bra holster New Years Day. A Baltimore man was arrested February 16th after the shotgun he was cleaning discharged, seriously wounding his son. Those stories represent a small number of reported incidents.

#JeSuisCharlie: The Paris Attack

mohYou will hear a great deal of spin, propaganda and lies, particularly from the gun pornographers in the NRA. They will tell you French police do not carry weapons and that gun ownership in France is banned. The responding police to the Charlie Hedbo attack were not the Gendarmerie Nationale, but civilian Police nationale, or Surete (Sur-ay-tay), like our civilian police here in the US. All Surete are issued and carry a Swiss SIG Saurer Pro-series semi-automatic pistol 9mm pistol, and many carry rifles and/or shotguns in their vehicles like US domestic police.

By domestic standards, crime is violent rare in Paris and France as a whole. Terrorism and extremist attacks are rare as well. The Surete has excellent SWAT, anti-terrorism and rapid response units. Communication and coordination between Surete and the Gendarmerie is excellent as well. The first police responded in Paris within 3 minutes. Video from today’s attack show that the police were surprised while responding, facing combat hardened gunmen with assault weapons and possibly body armor before they could even draw their weapons.

Two officers were killed. One was hit in a hail of bullets and wounded. The attackers then finished the officer off moments later. Will FOX News televise their funeral hour by hour as well, or will they forget this story when Michelle Obama makes a remark about bacon or vegetables or school lunches in a few days? imagesYOXYKALI

Gun ownership in France is permitted, but is licensed. Stock piling bullets for pistols is not permitted. Owners of small arms may keep 20 rounds at any one time. Hunters, sportsmen and rifle owners are permitted to maintain 1000 rounds. Guns can be owned legally with appropriate and reasonable permits. Ownership of guns in France is common and easier than in many other European countries. However, with the EU, there are no border customs control. Buying guns legally or illegally in Eastern and Southern Europe, or Turkey and transporting them throughout Europe is as simple as buying guns at an Indian gun fair and driving them to the south side of Chicago.

As for reaction by Muslims to the attack, apparently for Charlie Hedbo’s cartoon depictions of the prophet Muhammad, The Arab league in Cairo and Al-Azhar, Sunni Islam’s most prestigious, organizations, Canadian Muslim leaders, Saudi Arabia and British Muslim leaders immediately and strongly condemned the attack. It is the same for ISIS as well, with many Muslim leaders and nations condemning the group.imagesSIRRUYDA

Finally, a leading Muslim cleric in Britain remarked on the BBC that “Journalists are free to produce those cartoons in a free society, and we as Muslims are free to peacefully oppose them…We Jews, Muslims and Christians must come together and unify against this threat.” The journalist responsible for the cartoon is Stephanie Charbonnier. He was killed in the attack.

While respect and sensitivity to diverse perspectives in the community, freedom of expression must be paramount throughout society. Charlie Hebdo clearly carried that to an extreme, but in their defense the magazine was an equal opportunity offender. That is why we have published a cross-section of those offending covers, with apologies to all of our friends who might take offense. The freedom of expression and of journalism, however is much larger that individual sensitivities. We will likely never post them again, but out of duty in defense of expression and freedom, and to honor the memories of the dead, not only in Paris, but for those oppressed by any censorship, including American corporatist censorship and self-censorship, Revolution and Beer will not waver from its responsibility. Race Baiting and Ferguson. All about gun sales?

Sadly, they are getting too easy to predict, but that still doesn’t seem to mitigate the danger the NRA poses to American democracy. By all appearances the media and NRA are eagerly stoking the flames of racial animosity, and even violence as a means of reversing flagging gun sales in 2014. Earlier this year in a Revolution and Beer exclusive, Rand Paul’s effort to pass legislation requiring every licensed commercial pilot in America to carry a weapon was exposed as a naked scheme to boost gun sales. In Paul, the NRA has bought and paid for a ready and willing political ally.

Prior to Newtown the NRA invested $294 thousand dollars in purchasing members of Congress, or more than $21 million since 1990. http://www.opposingviews.com/i/society/guns/how-much-did-nra-pay-senators-who-killed-gun-background-checks Both then Senate Minority Leader Mitch McConnell and Senator Rand Paul benefitted greatly from the NRA’s abundant, string’s attached generosity. That does not include tens of millions in political advertisements which were often conveniently placed to support specific candidates. In fact, all of those Senators which appeared on FOX and on rightwing media decrying any reasonable gun control legislation, like Ted Cruz, James Inhofe, Roy Blunt, Jim Risch, Chuck Grassly and Saxby Chambliss, to name a few, received thousands in donations from the NRA.

After reading and re-reading the Ferguson Grand Jury testimony and evidence, I was perplexed at the blatant misrepresentation by talk show hosts on the right, like Sean Hannity, Michael Savage and Rush Limbaugh. Revolution and Beer has remained very close to the Brown case, and was first to question the initial reports that Officer Darren Wilson suffered serious injuries during the altercation with Brown. Then in a CNN article following this years Black Friday sales, this line jumped out:

“Traditionally, Black Friday is one of our busiest days for transaction volume,” Fischer said.
Indeed, Friday saw the highest number of background checks ever for a Black Friday, and second in history. The highest day on record was December 21, 2012, with more than 177,000 background checks.”

Recognize that date, December 21st, 2012? Just 7 days earlier Adam Lanza walked into Sandy Hook Elementary school in Newtown Connecticut and fatally shot 20 children and 6 adults. Recall that the rightwing media reacted swiftly against gun control proponents, and rumors circulated allegedly by the NRA or its surrogates of gun grabs and bans.

In August, Businessweek reported on steeply slumping guns sales. Gunmaker Smith and Wesson had seen 2nd quarter sales dropping 23%, with profits suffering at 45% Other gunmakers suffered similarly. More and more the politically motivated industry has looked to the NRA, once a sportsman’s organization, to act instead as the marketing wing for the industry. For the NRA, whose best marketing tool is FOX News and rightwing talk radio that effort is manifest in manipulating the aftermaths of America’s darkest and bloodiest moments. Although I reject the word, that has to about as close to evil as one can get.

Last Saturday’s Show Notes

The burning question on our minds: Could we get the world back on track if we cancelled the debt of the nations and the global working class? It’s an idea that you hear amidst discussions of solutions to the global economic crisis, and it’s far more historically grounded in reality than you might assume. We’ve been inspired by the writing of those such as David Graeber and Murray Bookchin, as well as the Occupy movement’s work on the debt alleviation issue with Strike Debt and Rolling Jubilee. WC mentioned these campaigns throughout the week last week, and we wanted to get deeper into the broader details and circumstances.

The video below is a wonderful discussion from this year’s Global Uprisings conference featuring David Graeber, along with Silvia Federici (in absentia), and George Caffentzis. I first came across this on ROAR magazine on Twitter. It’s lengthy, but believe me, it’s worth the view. They explore the circumstances of contemporary work environments and the nuances of the debt structure.

Climate and Action

We also discussed the climate talks that took place in Warsaw, and the frustration expressed by attendees of the green movement: http://www.bbc.co.uk/news/science-environment-25044961. We also discussed how the global climate discussion is being coopted by multinational capitalists, and the cycle of such coopting and marginalization of successful or urgent grassroots social justice campaigns. This frustration with the swindling of the dialogue is expressed clearly in this statement from Oxfam‘s Celine Charveriat:

“We need to tell them you are not allowed to make a mockery of this process. We can’t continue to watch in silence. Enough is enough.”

Here in the states we’ve heard many statements on the importance of diversifying our energy supply to include much more sustainable/renewable sources by our politicians, including many from president Obama throughout his presidency; with a spike during both of his presidential campaigns. However, the realities of hydro-fracking and dirty coal are still causing massive destruction to our surroundings, and there seems to be very little political will by our politicians to curb the rapid expansion of these forms of resource extraction.

We then moved on to discuss how we’ve let ourselves get duped by special interests before, and the importance of all working class people to step forward and take more control over this discussion. We also explored the parallels between the climate situation and the debate over guns; and the use of the race card, and how special interests like the NRA are playing the same game when it comes to the development of any sort of rational gun policy. One example would be the recent murder of Renisha McBride, and the counter narrative being espoused by right-wing pundits related to a grossly exaggerated “epidemic” of the violent pranking known as “Knock Out.”

We also expressed a little of our own frustration over mayor Rahm’s privatization parade, and how the “negotiated” solutions often leave us in a soar place, paying more for weaker service and no accountability.

The Living Constitution and the Amendment that dare not speak its name!

WARNING: After this you may never view the constitution the same ever again.

It is a matter of perspective, it would seem, dividing the Left and the Right on which constitutional amendments are the most important. To the paranoid, frightened or dangerously immature, the second amendment would pretend to be the most important. Fear not, however, this is not just another gun-grabbing Liberal dirge I actually see value in responsible gun ownership, with reasonable oversight. And if I may for a moment, the perverse every man, woman and child packin’ 24/7 culture is the mark of idiots not patriots. By that measure child porn should be legal, or screaming the N-word in church should carry no repercussions because they are the ultimate fulfillment of the First Amendment.

Too much? The NRA has fought even the most “liberal” gun restraints, advocating for guns to be carried everywhere, and that people should own machineguns, and that there should be no restrictions at gun shows- shown as the primary source of guns that end up on the killing streets of this nation. Rep. Joe Walsh on his nightly gun porn-propaganda program argues for guns everywhere and screamed his paid for outrage by advocating a boycott of Starbucks simply because the CEO requested-requested-requested that patrons not bring weapons into their coffee shops.

Walsh, the NRA, Beck and other gun pornographers attest that the right to bear arms at church, while shopping, during sex is a God-given right. Simply because someone writes the words down as a God-given right doesn’t…does anyone believe that god appeared to the so-called founding fathers to proclaim that “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”? Seriously?

True to the letter of the law, I should be able to keep a bazooka in the car, or own a rocket launcher or be able to lay landmines around my property. They are all “arms” after all. But we don’t allow such arm-aments of warfare in civil society in America, do we? Reasonable people understand that Thomas Jefferson likely did not anticipate a Predator drone or even the Thompson submachine gun, which was responsible for unprecedented carnage, even by today’s standards, on the streets of this nation before being banned during the 1920s and 30s.

On the other hand are primarily Progressives, Liberals and centrists who believe that the First and the Fourth amendments are the most sacrosanct. And there is a substantial case to be made that no other freedoms are possible without the right of free speech or the prohibition against unreasonable search and seizure remaining strong. Many would argue that the current masturbatory-schoolyard impassion over guns points to a notion that the constitution is a historic document in need of constant scrutiny, oversight and evolution. That argument is supported by the fact that women and blacks can vote, and that prohibition went into effect banning liquor, and then was repealed by reasoned souls.

In defense, a bit, of the gun-pervs, no change should ever be made lightly, and must always be viewed in context of the past, present and most especially the potential for future abuse. But the constitution is very definitely a living document. The all but forgotten 3rd amendment that protects all of us from soldiers quartering in our homes is a shining example. It is an example that neither the Left nor the Right seem to refer to much. The Left simply ignores it as a relic of the past, while the Right just hopes that it remains safely in the shadows where it won’t be used again their flimsy as toilet paper arguments for gun proliferation. The 3rd amendment truly is the amendment that dare not speak its name

Many will find this shocking, some a heresy and others outrageous, but despite pretense, the constitution and these United States is a deeply flawed document, only curtailed from being a document of oppression by the diligence and sacrifice of citizen activists. Every defense-every defense and expansion of civil rights for the truly common citizen has been hard fought, not by gun slinging Tea Party types, and definitely not the cottage-cheese assed playground bravado of talk radio hosts, but by the stalwart, unflinching activism and organizing of citizens compelling change through non-violence. That the state and status quo media have always tacitly and often explicitly encouraged or supported violence against those activists underscores the oppressive tendency a static or unchanging constitution would protect.

Need more evidence? Everything is, as we have seen, in the perspective, and perspectives by their nature inform interpretation. The very first line of the constitution may be interpreted to completely negate all of the amendments to the constitution. Through that interpretation every American may be stripped of their “God-given” rights: “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

It is this that becomes the most dangerous threat to the freedom of Americans, “… insure domestic Tranquility, provide for the common defence, promote the general Welfare…” First of all, they spelled “defense” wrong, at least by contemporary standards-part of that living document thing. But “insure domestic tranquility?” That is a dangerously broad and interpretive phrase. What becomes the bulwark against its abuse is the weight of the citizenry, not with guns. That has never worked, but with true pressure by an active and engaged citizenry…
